I know most of you have seen Governor Northam’s Executive Order which became effective May 29, 2020, requiring people in public places to wear face masks. I hate those darn things but I’ve come to realize that they are necessary if we are to control the spread of the coronavirus. The mask is not a perfect defense but that, together with “social distancing,” is the best hope we have, in my opinion.
One “legal” thing we business owners must be concerned about is potential liability if we do not wear a mask and someone comes into our place of business and claims to have caught the “virus” there. The same is true for business employees. A claimant would have a tough burden of proof in that event but the potential risk is there and companies that ensure businesses are worried about that risk. Business owners are well-advised to consult their business liability insurance carriers for advice about how to proceed. The old saying is that “an ounce of prevention is worth a pound of cure.”
